But today the nation’s public defender system has become a mockery of justice. To provide an accused with a public defender who has three hundred other cases to defend is simply to laugh in the face of both justice and the accused himself. It takes me months to prepare the average criminal case for trial. The trial itself can take weeks, even months. While O.J. Simpson was being tried in Los Angeles for murder, a case that cost millions to defend and months to conclude, another black man was being tried in the same courthouse for a similar murder. It took only three days for a jury to find him guilty. He had a public defender with scores of other cases to defend. Many prosecutors boast that they have over a 90 percent conviction rate. Little wonder. Under the present public defender system the prosecutors should enjoy one hundred percent convictions, and many in fact approach perfect conviction rates. The public defenders in seven states have finally refused to take on any new cases. It’s about time. If I walked into court to defend my client and had never talked him, never previously opened his file, never discovered the witnesses against him, much less interviewed them, never reviewed the evidence in the hands of the prosecution, never demanded my clients rights to discovery, never read the cases relevant to the case at hand, never prepared the cross examination of the witnesses against my client, never … and on and on, I would be guilty of legal malpractice. Every public defender who purports to represent an accused under circumstances in which he or she has neither the time nor the resources to fully defend the client is guilty of malpractice. These public defenders cannot be saved from malpractice because they are crushed under a ridiculous case load - some with even as many as five hundred cases or more. No one who was accused with such an attorney has received a fair trial and every such accused is entitled to an appeal on that basis alone. The judge must not sentence the accused under these circumstances because the judge would be taking part in a fraud on the system. Yet hundreds of thousands of indigent persons go to prison each year under circumstances no better than those outlined above. When I was coming up as a young prosecutor, the defendants were represented pro bono by the lawyers in the local bar. It was part of the duty of members of the bar to take part in the justice system. Today that idea is unheard of. The practice of law is first and foremost a money-making profession. I see nothing wrong with that notion, but what about giving back? Every trial lawyer should be required to take on a couple of pro bono cases every year. At our office we have a separate pro bono law firm and have for over ten years. It often brings us more satisfaction than our big money wins. The job of a lawyer is to represent the people - the lost, the forgotten, the damned, the hated, the voiceless and the poor. Indeed, God forbid, we may one day become one of those who are entitled to representation but cannot afford it. Every time an accused goes to prison without having received a fair trial we are one step closer to the loss of our own freedoms. Our rights are, in fact, being fought for by public defenders who can never fulfill their duty to their clients because of their pathetic, impossible, caseloads. When they fail, we are in danger. Our system becomes a hypocritical charade. And we prove, once and for all, that the promised justice for all in America is an evil lie that is imposed on the poor. I sincerely appreciate your help in this matter. These new Medicare providers, Trailblazer and Palmetto, have removed a treatment option (SBRT/CyberKnife) for prostate cancer that is one if not the very best and most cost effective. Medicare had covered treatment of prostate cancer by the CyberKnife but effective de. 15, 2008 that treatment option is no longer available in the Palmetto region. In June of 2008 Trailblazer removed SBRT/Cyberknife as a treatment option. The alternate external beam treatment (IMRT) will cost Medicare a %100 more than SBRT/CyberKnife. This will also increase the patients’ side effects, and reduce cure rates. IMRT requires 40 days of treatment the SBRTCyberKnife requires 5 days of treatment. In my opinion this is criminal. Their actions increase the cost to Medicare and lower the quality and may result in death due to failure of cure by IMRT. It seems criminal for a Medicare service provider to eliminate a cancer treatment option that would same the country tens of millions of dollars and benefit cancer patients at the same time. Medicare providers Palmetto in California and Trailblazer (TX, OK, CO and NM) are increasing Medicare cost and providing lower quality medical care. Both have eliminated stereotactic body radiation therapy (SBRT)/CyberKnife coverage for prostate cancer treatment. The previous Medicare providers covered SBRT for prostate cancer. The alternative external beam treatment, IMRI, will double the cost to Medicare and increase the cost for patient’s transportation and lodging (if required) by 800%. Trailblazer stopped paying for prostate cancer treatment with SBRT June 13, 2008. Effective Dec. 15, 2008 Palmetto will stop treatment of prostate cancer and cancer of the pancreas. Patients should be entitled to have a say in selecting the best treatment for their best quality of life and most important their life. This should be a fundamental right. Palmetto is removing a cancer treatment by SRS/SBRT/CyberKnife for the Prostate and Pancreas. This will result in higher cost to Medicare, higher cancer failure rates adding to patient suffering and additional treatment (adding cost), higher incidence of side effects reducing the quality of life for patients. This treatment was covered by the previous Medicare administrator. Why would, SRS/SBRT, the best External Beam (EB) radiation treatment for prostate cancer be removed? The new policy now covers an External Beam radiation option (IMRT) that cost a 100% more than SRS/SBRT , has increased side effects and a lower cancer cure rate. Why? Also consider the Palmetto EB option (IMRT) requires 40 days of treatment. The SRS/SBRT by CyberKnife requires 5 days of treatment. The cost of patient travel and inconvenience is 800% higher as the result of the irresponsible actions of Palmetto. Palmetto was provided medical evidence by experts in the field (see attachment) for reconsideration before they re-released their policy changes. Their final comment period runs from Oct 30 thru Dec 15, 2008. The Center for Medicare and Medicaid (CMS) mission statement is as follows: CMS' mission is to ensure health care security for its beneficiaries. A major component in achieving this mission is the successful administration of Original Medicare, or Fee-for-Service (FFS) Medicare. Medicare Contracting Reform (or section 911 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003) is a major component in achieving this mission. Section 911 mandates that the Secretary for Health & Human Services replace the current contracting authority to administer the Medicare Part A and Part B FFS programs, contained under Sections 1816 and 1842 of the Social Security Act, with the new Medicare Administrative Contractor authority. Through the implementation of Medicare Contracting Reform, CMS will establish a premier health plan that allows for comprehensive, quality care and world-class beneficiary and provider service. In summary the Palmetto changes are not in compliance with CMS Medicare Reform. World-class treatment for early state prostate cancer is SRS/SBRT. Their changes will also cost Medicare additional millions of dollars and reduce the patient’s quality of life. In my opinion Palmetto is acting as a Doctor (do they have a license to practice medicine?) for Medicare patients. If they are, then their actions are in violation of the Hippocratic Oath. Is Palmetto acting as a Doctor? As a result of my personal fight with Blue Shield of California for prostate cancer treatment by the CyberKnife I have become a prostate cancer advocate for research, education, screening and treatment. Nothing in this world is more alarming then the fact that United States Citizens are being attacked and done harm by the Homeland Security Satellite Program. I was attacked while in Ohio early last year, March and April, after some traveling to Oklahoma, and on to Amarillo, Texas. Apparently, this torturing started before my trip West, for I suffered substantially, prior to that time, not realizing what was happening to me. Throughout 06-07 Fall-Winter, October until the time I went on my journey West in March, I suffered an agonizing experience of an equal consequence. I consider it much more evil and more deadly, for it was done within my home, day and night, while sleeping, while eating, while using the bathroom. I’m sure you are extremely hesitant about even thinking such a thing is happening. Yes, this was my first thought when Satellites defense technology came to mind, “Is it possible?” “Could it be?”, someone like me, being under surveillance, being attacked by such high tech equipment?” No Way! I thought. But, after weeks of suffering its affect, I discovered truly, satellites are involved. Of course, it wasn’t an overnight revelation. Sadly, nearly all affected citizens have no idea as to why they are in throbbing pain—only a few, those involved would understand such uncivilized tactics. Spying and harm is going on today and now. Are you willing to believe such evil, as it happens, is going on in my home? The End.

I don't think McCain himself is going to be commenting on here so it might be better to word these are more general questions. I keep seeing people doing this on candidates pages. That being said I don't really have a solid answer. But the fact that he doesn't mention it anywhere on his campaign website makes me believe he either doesn't or isn't willing to fight for it if he does. Which in my opinion is one of the only good things about him.

The seven weeks is really a joke as unemployment WILL continue to rise and rise. It needs to be a total of 52 or more as it was in the past. L.A. seeing more people living out of their cars By CHRISTINA HOAG, Associated Press Writer Mon Jun 23, 2:48 PM ET LOS ANGELES - Having lost her job and her three-bedroom house, Darlene Knoll has joined the legions of downwardly mobile who are four wheels away from homelessness. She is living out of her shabby 1978 RV, and every night she has to look for a place to park where she won't get hassled by the cops or insulted by residents. "I'm not a piece of trash," the former home health-care aide said as she stroked one of five dogs in her cramped quarters parked in the waterfront community of Marina del Rey. Amid the foreclosure crisis and the shaky economy, some California cities are seeing an increase in the number of people living out of their cars, vans or RVs. Acting on complaints from homeowners, the Los Angeles City Council got tough earlier this year by forbidding nearly all overnight parking in residential neighborhoods such as South Brentwood. But some people are just crowding into other parts of the city, including the seaside community of Venice, where dozens of rusty, dilapidated campers can be seen lined up outside neat single-family homes. The stench of urine emanates from a few of the vehicles, and some residents say they have seen human waste left behind. "They're nasty and gnarly," said Venice resident Jeff Scharlin. "We've heard about drug dealing and prostitution in them. I've never seen it, but visually they're a blight and they take up parking space." In Los Angeles, as in many other cities, it is illegal to live in vehicles on public streets. But the law is not easy to enforce. Police have to enter a vehicle to find signs that people are living there, such as cooking or sleeping, and occupants often refuse to answer when cops knock. An easier way is to restrict overnight parking. In L.A., a first offense carries a $50 fine, and subsequent violations can cost as much as $100. Parking-enforcement officers often give vehicle owners a warning and tell them to move on before issuing a ticket, and that usually solves the problem, said Alan Willis, a city transportation engineer. But other cities in the area are not as lenient. "I had my motor home towed in Culver City. It cost me $500 to get it out," said Desiri Hawkins, who lives in a small RV in Venice. "I got ticketed in Santa Monica and had to go to court." Tourist states with temperate climates, such as California and Florida, have long been magnets for the homeless. Los Angeles is the nation's homelessness capital, with an estimated 73,000 people on the streets. A survey of 3,230 homeless people last year in Los Angeles County found nearly 7 percent living in vehicles, according to the Los Angeles Homeless Services Authority. "It's trending toward an increase," said Michael Stoop, acting executive director of the National Coalition for the Homeless. "People would rather live in a vehicle than wind up in a shelter, and you can't stay on a friend's couch forever." People living out of their cars or campers tend to be more well-off than the homeless on the street. They usually have jobs or disability checks that enable them to maintain an old camper but do not allow them to afford rent. "For more working-class and lower-middle-class people, the car is the first stop of being homeless, and sometimes it turns out to be a long stop," said Gary Blasi, a University of California, Los Angeles, law professor and activist on homeless issues. Some Venice residents are clamoring for overnight parking restrictions. But parking limits in oceanfront neighborhoods are problematic because the California Coastal Commission requires communities to accommodate surfers, fishermen and other early-morning beachgoers. "The complaints are getting louder and louder," said Los Angeles City Councilman Bill Rosendahl. For years, some cities such as Santa Barbara, Calif., and Eugene, Ore., have accommodated people who live out of their vehicles. Activists in Venice are looking at some of those ideas. Santa Barbara, for example, allows vehicles to stay from 7 p.m to 7 a.m. in church and city parking lots. Knoll said she can barely afford to drive around with the rising price of gasoline eating away at the $950 monthly disability check she receives because of mental illness. She said she is also sick of police waking her up in the wee hours by pounding on her vehicle with their nightsticks, and she is tired of fighting with residents who call her "lowlife scum" and hurl other insults. "We need somewhere we can have a safe haven, where we won't be harassed," Knoll said as the wind from a passing car rocked her RV. "I never thought I'd be living like this, but I'm stuck. This is it for me."

The country cannot afford to extend benefits. There are jobs available you just need to take something less than you want and maybe two jobs. Everyone must encourage your reps to not accept any pork to the bailout bill coming.
