[Footnote] 1This review and report of activities of the Committee on Foreign Relations during the 108th Congress is submitted in response to the requirements of Rule XXVI 8(b) of the Standing Rules of the Senate, which stipulate that all standing committees report to the Senate, not later than March 31 of each odd-numbered year, on its legislative activities during the preceding Congress.

During the 108th Congress, the Committee on Foreign Relations pursued an ambitious agenda, which included 249 hearings and formal meetings. This number consisted of 158 full committee hearings and meetings, 42 subcommittee hearings, 47 meetings with foreign leaders, and two meetings of the Policy Advisory Group. The Foreign Relations Committee met more frequently than any other committee in the Senate. No other Senate committee held more than 161 meetings. Only three Senate committees met half as often as the Foreign Relations Committee.

The committee devoted much attention to overseeing U.S. policy towards Iraq during the 108th Congress. The committee held 23 hearings on Iraq--5 prior to the coalition invasion and 18 after that time. The committee examined numerous issues related to Iraq, including security threats within the country, the regional implications of the conflict in Iraq, the allocation and management of reconstruction funds, the status of the coalition operating in Iraq, and the prospects for Iraqi democracy and a transition to a civil society.

Beyond Iraq, the full committee held 9 hearings on North Korea, 5 each on Afghanistan and the expansion of the North Atlantic Treaty Organization, and 4 on non-proliferation issues. Other topics on which multiple hearings were held included: U.S. public diplomacy, international hunger, the State Department budget, the Millennium Challenge Account, U.S. foreign assistance programs, Middle East peace negotiations, the African Growth and Opportunity Act, and the HIV/AIDS crisis. Other nations on which the committee held a hearing included: China, Colombia, Cuba, Haiti, Iran, Libya, Mexico, Pakistan, Sudan, Syria, and Venezuela.

The committee on Foreign Relations has the unique responsibility to receive foreign dignitaries, including presidents, prime ministers, and foreign ministers. The committee held 47 diplomatic meetings with visiting dignitaries. These included meetings with leaders from Colombia, Egypt, Georgia, Germany, Greece, India, Israel, Italy, Jordan, Pakistan, the Philippines, and many other nations.

The committee confirmed 169 nominations during the 108th Congress, more than all but one other Senate committee. The committee also confirmed 2816 Foreign Service promotions. Of the 169 nominations, 98 were for ambassadorial positions. The hearings associated with these nominations are important statements of U.S. policy that are carefully scrutinized by the nation that will receive the ambassador, as well as others in the affected region. Among the most notable ambassadorial nominations passed by the committee during the 108th Congress were John Danforth to be U.S. Representative to the United Nations and John Negroponte to be Ambassador to Iraq.

The committee reported 27 treaties, 26 of which were approved by the Senate. These included the NATO Enlargement Protocols (Treaty Doc. 108-4), the Moscow Treaty (Treaty Doc. 107-8), and the IAEA Additional Protocol (Treaty Doc. 107-7).

The one treaty approved by the committee that was not passed by the Senate was the U.N. Convention on the Law of the Sea (Treaty Doc. 103-39), which, under Senate rules, was returned to the committee calendar at the end of the Congress. The Law of the Sea was one of five treaties that the Bush administration placed in its `urgent' category on their 2002 list of treaty priorities submitted to the Foreign Relations Committee. The committee held two extensive public hearings on the Convention at which administration and private witnesses testified. The treaty received the endorsement of the State Department, the Defense Department, the Navy, the Commerce Department, the Coast Guard, and other agencies. Between October 2003 and February 2004, the SFRC held four briefings on Law of the Sea for committee staff and the staff of all committee members. In February 2004, the committee approved the resolution of ratification 19-0. Subsequently, the treaty did not receive floor time in the Senate.

In each session of the 108th Congress, the committee reported by a vote of 19-0 a comprehensive foreign affairs authorization bill (S. 1161 and S. 2144), authorizing appropriations for the operating budgets and programs of the State Department, the U.S. Agency for International Development, the Peace Corps and the Broadcasting Board of Governors. In addition to authorizing funding, the legislation provided personnel authorities and updated other authorities that the foreign affairs agencies need to carry out their functions efficiently and effectively. In considering both bills, the committee emphasized such priorities as the effectiveness of the non-military side of the U.S. Government in the battle against terrorism, the safety of U.S. personnel serving in embassies overseas, adequate compensation for those serving in dangerous posts, and improved effectiveness of international information and education programs.

During floor consideration in July 2003, other committee initiatives were added to the bill, including authorization of the Millennium Challenge Corporation. After two days on the Senate floor, the bill was pulled from consideration after an amendment was offered on a domestic issue unrelated to the contents of the bill. During the second session of the 108th Congress, the continued threat of unrelated amendments and other factors kept the foreign affairs authorization bill from being brought to the floor.

Despite the legislative stalemate on the comprehensive legislation, the committee advanced key components of the bill through other means. The committee worked in a bipartisan fashion with Senate appropriators as well as with the House International Relations Committee to include congressional authorization of the Millennium Challenge Corporation in the FY 2004 Consolidated Appropriations bill (PL 108-199). The committee also worked with the Governmental Affairs Committee to pass a modified version of a committee bill establishing a free press institute at the National Endowment for Democracy (S. 2096). The modified bill was included in the intelligence reform legislation that passed the Congress in December 2004 (PL 108-458).

In 2003, the Foreign Relations Committee initiated a Policy Advisory Group (PAG) to study how best to organize the U.S. government in preparation for post-conflict stabilization and reconstruction missions. This group of outside experts met twice with the committee. From this process, the committee developed the bipartisan Stabilization and Reconstruction Civilian Management Act of 2004 (S. 2127), introduced by Senators Lugar, Biden, and Hagel. The bill was included in the comprehensive foreign affairs authorization bill, which the committee passed unanimously. It attempts to establish a more robust civilian capability to respond quickly and effectively to post-conflict situations or other complex emergencies. After committee passage of S. 2127, the Bush administration pressed forward with complementary administrative changes. The administration established the Office of Reconstruction and Stabilization at the State Department to coordinate U.S. post-conflict responses and prepare for future contingencies.

The committee was active in international economic matters during the 108th Congress. The committee passed seven tax conventions and protocols, including the landmark Japan Tax Treaty (Treaty Doc. 108-14). Each of these tax treaties was approved by the Senate. The committee expedited passage of the Japan Tax Treaty and the Chairman encouraged the Japanese Diet to do the same. Both legislative bodies concluded work on the Treaty prior to March 31, 2004. As a result of this action, some provisions of the Treaty went into force on July 1, 2004, instead of January 1, 2005, as anticipated. This allowed American companies doing business in Japan to receive the economic benefits of the treaty six months earlier than planned.

The committee and the Senate also passed 8 protocols amending bilateral investment treaties and a reauthorization of the Overseas Private Investment Corporation (PL 108-158). In addition, it played an important role in the passage of the AGOA Acceleration Act of 2004 (PL 108-274), even though this bill fell under the jurisdiction of the Finance Committee. The committee held two hearings on the bill, which highlighted its importance as a foreign policy tool and as a means to improve development in Africa.

Matters related to the international environment also received committee attention during the 108th Congress. The committee reauthorized the Tropical Forest Conservation Act (PL 108-323) and passed two fishing treaties (Treaty Docs. 108-1 and 108-2) and a treaty with Russia on polar bear conservation (Treaty Doc. 107-10). The committee also held a hearing and briefing on the Stockholm Convention on Persistent Organic Pollutants (Treaty Doc. 107-5) and the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade (Treaty Doc. 106-21). These two conventions are still pending before the committee.

The committee developed the Comprehensive Peace in Sudan Act (S. 2781), which authorized an additional $300 million in assistance to relieve the humanitarian crisis in Sudan. The bill was announced at a hearing on Sudan where Secretary of State Colin Powell testified that the State Department had `concluded that genocide has been committed in Darfur.' The bill became law in December 2004 (PL 108-497).

The committee held the first Congressional hearing on corruption and mismanagement in the U.N.'s Oil for Food program related to Iraq. It also launched an ongoing review of the operations of the five multilateral development banks--the Asian Development Bank, the World Bank, the European Bank of Reconstruction and Development, the African Development Bank, and the Inter-American Development Bank. The committee held three hearings and sent committee staff to the Philippines, Paraguay, Lesotho, Argentina, Sri Lanka, Cambodia and South Africa to look into corruption allegations. A key purpose of the banks is to alleviate poverty in third-world countries. The committee plans to continue monitoring their performance and will consider legislation containing reform measures to combat corruption within the banks and their funding processes.

In fulfilling its legislative and oversight responsibilities, the committee passed 20 bills and joint resolutions and 39 concurrent and Senate resolutions. The table that follows is a tabulation of the legislation in this report:

2. OTHER TREATIES CONSIDERED BY THE COMMITTEE

On October 14 and 21, 2003, the committee held hearings (printed in the Executive Report) on the Law of the Sea Treaty (Treaty Doc. 103-39) and on February 25, 2004, reported (Exec. Rept. 108-10) the Treaty to the full Senate with declarations and understandings. In addition, the Senate Committees on Environment and Public Works, Armed Services and Select Committee on Intelligence, as well as the House Committee on International Relations held hearings on the Treaty subsequent to the Foreign Relations Committee referral to the full Senate. The full Senate took no action on the Treaty, and it was rereferred to the committee at the end of the Second Session.

On June 17, 2003, the committee held hearings on seven international agreements relating to aviation and the environment. Five of these agreements were approved by the Senate, but two of them were not reported out of the committee: The Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade (Treaty Doc. 106-21) and the Stockholm Convention on Persistent Organic Pollutants (Treaty Doc. 107-5).

On June 17, 2004, the committee held hearings on three conventions and a protocol relating to law enforcement: Inter-American Convention Against Terrorism (Treaty Doc. 107-18); Protocol of Amendment to the International Convention on the Simplification and Harmonization of Customs Procedures (Treaty Doc. 108-6); Council of Europe Convention on Cybercrime (Treaty Doc. 108-11); and U.N. Convention Against Transnational Organized Crime (Treaty Doc. 108-16).
